• Connect and manage social media accounts (Facebook Pages, Instagram Business)
• Create and schedule marketing content
• Generate AI-powered marketing copy and visuals
• Access stock images and videos
• Publish content to connected social media platforms

3. Account Registration

To use Orchestra ADS, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription and Billing

4.1 Plans and Pricing

We offer various subscription plans with different features and limits. Current pricing is available on our website. We reserve the right to change pricing with 30 days notice.

4.2 Payment

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.3 Free Trials

We may offer free trials for certain plans. At the end of the trial, your subscription will begin and you will be charged unless you cancel before the trial ends.

4.4 Refunds

Subscription fees are generally non-refundable. However, we may offer refunds at our discretion for certain circumstances. Contact support for refund requests.

5. Acceptable Use

You agree NOT to use Orchestra ADS to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Post spam, misleading, or deceptive content
• Harass, abuse, or harm others
• Distribute malware or engage in phishing
• Circumvent platform rate limits or restrictions
• Use automated systems to access the Service without permission
• Violate Facebook, Instagram, or other connected platform terms
• Post content that is illegal, harmful, threatening, defamatory, or obscene

6. Content Ownership and Licenses

6.1 Your Content

You retain ownership of content you create or upload. By using the Service, you grant us a limited license to store, process, and publish your content as necessary to provide the Service.

6.2 Generated Content

AI-generated content created through our Service is provided for your use according to your subscription plan. You are responsible for ensuring generated content complies with applicable laws and platform policies.

6.3 Stock Content

Stock images and videos accessed through our Service are licensed from third-party providers (Shutterstock, Unsplash, Pexels). Usage is subject to those providers' license terms.

7. Social Media Integration

When you connect social media accounts:

• You authorize us to access and post to those accounts on your behalf
• You remain responsible for content published through our Service
• You must comply with the terms of each connected platform
• We are not responsible for changes to third-party platform APIs or policies

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions
• Force majeure events

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months prior to the claim
• We are not responsible for content you publish or actions taken by third-party platforms

10. Indemnification

You agree to indemnify and hold harmless Orchestra ADS, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your payment method fails
• Required for legal or security reasons

Upon termination, your right to use the Service ends immediately. We may delete your data after a reasonable retention period.

12. Intellectual Property

Orchestra ADS, including its logo, design, features, and content (excluding user content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

13. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Italy, unless otherwise required by applicable consumer protection laws.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
